Report infringement
Send your notice to [email protected] with the subject line "Copyright notice". Include the overlay URL and the details listed below. We usually respond within a few business days.
Overlaify respects the intellectual property of creators, artists and brands, and our Terms of Service prohibit users from infringing it. Overlays on Overlaify are generated by AI from prompts that users write, and users are responsible for the content they create. If you believe content on the Service infringes your rights, this page explains how to tell us and what happens next. We follow the notice-and-takedown process of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512) and accept equivalent notices under other laws, such as the notice-and-takedown rules in the EU and China.
1. Filing a notice
Your notice must be in writing and include:
- your physical or electronic signature, or that of a person authorized to act for the rights owner;
- identification of the copyrighted work (or trademark or other right) you claim is infringed. If the notice covers several works, give a representative list;
- the specific location of the allegedly infringing material, such as the overlay URL (www.overlaify.com/o/…) or library page, with enough detail for us to find it;
- your name, postal address, telephone number and email address;
- a statement that you have a good faith belief that the use of the material is not authorized by the rights owner, its agent or the law; and
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the rights owner or authorized to act for the owner.
Notices about trademarks (logos, brand names), rights of publicity (someone's name or likeness) or other rights are welcome through the same address. Please include the same information, adapted to the right you are asserting, along with registration numbers where available.
Incomplete notices may delay our response. Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation that material is infringing may be liable for damages. Before sending a notice, consider whether the use may be fair use or otherwise permitted. General styles and themes are generally not protected.
2. What we do when we receive a notice
- We review the notice and, if it is complete, promptly remove or disable access to the material. For an overlay, we usually disable its hosted URL so that it stops loading in streaming software.
- We make reasonable efforts to notify the user who created the material and send them a copy of the notice. Your contact details may be included.
- We keep a record of the notice and the action we took.
3. Counter-notices
If your material was removed and you believe this was a mistake or a misidentification, or that you have the right to use it, you can send a counter-notice to the same address. It must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. federal district court for your address (or, if you are outside the United States, any judicial district in which Overlaify may be found), and that you will accept service of process from the person who filed the original notice or their agent.
When we receive a valid counter-notice, we forward it to the person who filed the original notice. If they do not tell us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material within 10–14 business days after receiving the counter-notice.
4. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are the subject of repeated valid infringement notices. We may also restrict or end access for any user who infringes intellectual property, even without repeated notices.
5. How we reduce infringement risk
- Our Terms require users to have the rights to everything they submit and prohibit requests to reproduce third-party logos, characters or designs without permission.
- Our AI is told to build overlays from its own code, CSS and inline graphics, and to use only Google Fonts (open-licensed) and Twitch-provided emotes as external resources.
- Your overlays are private by default. They are not shown in the public library or used in our marketing unless the creator chooses to share them.
6. Contact
Copyright agent: Overlaify, [email protected]. We may share notices we receive with the affected user or with organizations that track takedown requests, with personal contact details removed where appropriate.
