Terms of Service
Effective October 16, 2026
The short version
- Overlaify is a tool. You tell it what to build, and our AI writes the overlay code for you.
- Your prompts and uploads stay yours. Only use material you have the right to use.
- To the extent we have any rights in the overlays you generate, they are yours. Check them before you stream, because AI output can resemble existing work.
- Don't ask for other people's logos, characters or designs unless you're allowed to use them.
- If someone reports that an overlay infringes their rights, we may take it down. Repeat infringers lose their accounts. See our Copyright Policy.
This summary is for convenience only. The full terms below are what apply.
These Terms of Service ("Terms") are an agreement between you and Overlaify ("Overlaify", "we", "us") covering your use of www.overlaify.com, the overlay studio, hosted overlay URLs, the overlay library, the Overlaify SDK and related services (together, the "Service"). If you use the Service, you agree to these Terms. If you don't agree, don't use the Service.
You must be at least 13 years old, and old enough to use Twitch in your country, to use the Service. If you are under 18, or under the age of majority where you live, you may only use the Service with the involvement of a parent or guardian who agrees to these Terms. If you use the Service on behalf of a company or organization, you confirm you can bind it to these Terms.
1. The service
Overlaify lets you describe a live-stream overlay in plain language. We send your description to third-party AI models, which generate HTML, CSS and JavaScript ("Output"). We host the result at a URL you can add to OBS or similar software as a browser source. Overlays can respond to public Twitch chat events from the channel you specify. We may add, change or remove features at any time.
2. Accounts
Some features require you to sign in with a third-party account, such as Google or Twitch. You are responsible for activity under your account and for keeping access to it secure. Tell us promptly if you believe your account has been compromised. You may not create accounts to get around credit limits, suspensions or bans.
3. Your content
What counts as your content
"Your Content" means everything you submit to the Service: prompts, change requests, overlay code you paste or edit, and any images, artwork, logos, fonts or other files you upload or reference, where those features are available.
You keep ownership
You keep whatever rights you already have in Your Content. You grant Overlaify a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, adapt and display Your Content and the Output generated from it, but only as needed to operate, secure and improve the Service for you. This includes sending Your Content to our AI and infrastructure providers, and serving your overlays to anyone who opens their URL. This license ends when you delete the content or your account, except for copies kept in routine backups or kept to comply with the law or resolve disputes.
We will not use Your Content or your Output in our marketing, put it in the public library, or make it available to other users unless you choose to share it or give us permission.
Your promises about Your Content
You represent and warrant that:
- you own Your Content, or you have every license, permission and consent needed to use it with the Service and to grant the license above;
- Your Content, and your use of the Output, does not infringe or misappropriate any copyright, trademark, right of publicity or privacy, or any other right of anyone else; and
- if Your Content shows or names a real person (for example, a photo of someone other than you), you have that person's permission.
We do not review Your Content before it is processed and we are not responsible for it. You are solely responsible for Your Content and for the consequences of using it.
4. AI-generated overlays
Who owns the Output
As between you and Overlaify, and to the extent permitted by law, you own the Output generated from Your Content. We assign to you any rights we may have in that Output. You can download it, edit it, host it elsewhere and use it on your streams, including commercially, as long as you follow these Terms. This assignment does not cover the Overlaify SDK, library templates or any third-party material that appears in the Output (see sections 7 and 10).
What we can't promise
- Output may not be unique. AI models can produce the same or similar output for different users. Your ownership doesn't extend to similar output that others generate independently.
- Output may not be protected by copyright. In some countries, material created mainly by AI can't be registered or protected as a copyrighted work. We make no promise that you can enforce exclusive rights in Output.
- Output may resemble existing work. AI can create content that looks like third-party logos, characters, fonts, artwork or designs, especially if a prompt asks for them. We tell the AI to use only approved external resources (Google Fonts and Twitch emotes). However, we do not check every Output for third-party rights and cannot guarantee that any Output is free of infringement.
Your responsibility
Review each Output before you use it publicly. You are responsible for making sure your use of the Output, and anything you add to it, does not infringe anyone's rights. If you are unsure whether you may use a particular brand, character or artwork, don't include it.
5. Acceptable use
You agree not to use the Service to create, upload, request, host or distribute anything that:
- infringes copyright, trademark, right of publicity, privacy or other rights. This includes reproducing third-party logos, brand marks, game or anime characters, or another creator's overlay designs or artwork, unless you are authorized to use them. General styles, moods and genres ("retro arcade", "cyberpunk", "cozy anime") are fine.
- falsely suggests that you are, or are endorsed by, a company, brand, platform (including Twitch) or person;
- is illegal, sexually exploits minors, promotes violence or terrorism, harasses or threatens others, or attacks people based on protected characteristics;
- contains malware, cryptominers, phishing, or code that tracks, fingerprints or collects data from viewers without their consent, or loads scripts or resources meant to get around the Service's restrictions;
- breaks Twitch's Terms of Service or Community Guidelines, or those of any other platform you stream on.
You also agree not to: get around credit limits, rate limits or access controls; scrape, overload or disrupt the Service; probe it for vulnerabilities without our written permission; resell access to the Service; or use the Service or its Output to build a competing AI overlay generator.
We may refuse prompts, block or remove Output, and suspend accounts that we reasonably believe break this section.
6. Hosted overlay URLs
Each overlay gets a hard-to-guess URL. Anyone who has that URL can load the overlay, so treat it like an unlisted link and share it only with tools and people you trust. We may disable or change a URL if we have to remove the overlay under these Terms or the law, or if the URL is being misused. We do not promise that hosted URLs will stay available forever. Download a copy of anything you need to keep.
7. Library templates and the Overlaify SDK
Overlays in the Overlaify library ("Templates") and the Overlaify SDK belong to Overlaify or its licensors. We grant you a non-exclusive, non-transferable license to use Templates you have access to on your own streams and content, including monetized streams, and to modify or remix them for that purpose. You may not resell, sublicense or redistribute Templates, or close variants of them, as templates, packs or assets, or offer them in a competing library. Premium Templates are available only while your plan includes them. If we offer the option to publish or sell your own overlays in the library, additional terms will apply when you do.
8. Credits and paid plans
Generations and edits use credits. Free daily credits reset every day and don't carry over. If a generation fails because of an error on our side, its credits are refunded automatically. Paid plans, top-ups, prices and what each plan includes are described on our pricing page when they are offered and may change. We will give you notice before a price change affects a subscription you already pay for. Except where the law requires otherwise, payments and credits are non-refundable, credits have no cash value, and credits cannot be transferred.
9. Copyright and other rights complaints
We respect the rights of creators and expect our users to do the same. If you believe something on the Service infringes your copyright, trademark or other rights, follow the process in our Copyright Policy. We respond to valid notices by removing or disabling the material. Where appropriate, we notify the user who created it and let them submit a counter-notice. We terminate the accounts of users who repeatedly infringe.
10. Third-party services
The Service relies on and links to third-party services, including Twitch, Google sign-in, AI model providers, Google Fonts and streaming software such as OBS. Your use of those services is governed by their own terms, and we are not responsible for them. Overlaify is not affiliated with, endorsed by or sponsored by Twitch Interactive, Inc. Twitch emotes and badges shown in overlays belong to their respective owners and are displayed as Twitch provides them.
11. Suspension and termination
You can stop using the Service at any time. To delete your account and its data, email us. We may suspend or end your access, and remove Your Content or Output, if you break these Terms, if we must do so by law, or if your use creates risk or legal exposure for us or others. Where reasonable, we will tell you first. Sections 3 (license for retained copies and your promises), 4, 7 (restrictions), 12, 13, 14 and 16 continue after termination.
12. Disclaimers
The Service, Templates and all Output are provided "as is" and "as available". To the fullest extent permitted by law, Overlaify disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, that overlays will work with every version of your streaming software, or that Output will be accurate, unique, or free of third-party rights.
13. Limitation of liability
To the fullest extent permitted by law, Overlaify will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, viewers, data or goodwill, arising from or related to the Service or these Terms. Overlaify's total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose and (b) US$50.
Some jurisdictions do not allow certain exclusions or limits on liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer that cannot be waived.
14. Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Overlaify and its operators from any third-party claim, and the related losses, damages, fines and reasonable legal fees, that arise from (a) Your Content, (b) your use of Output or Templates, including on your streams, or (c) your breach of these Terms or of anyone's rights. We will tell you about the claim and may take part in the defense with counsel we choose.
15. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will post the new version here with a new effective date and, where reasonable, notify you in the Service or by email before it takes effect. If you keep using the Service after the change takes effect, you accept the updated Terms.
16. General
These Terms are the entire agreement between you and Overlaify about the Service, together with the Copyright Policy and any additional terms for features you choose to use. If any part of these Terms can't be enforced, the rest stays in effect. If we don't enforce a provision right away, we have not waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets. Before starting any formal proceeding, please contact us first so we can try to resolve the dispute informally.
